Overview

This long-awaited fifth edition features recent statutory changes, significant new cases, expanded coverage of international developments, and new material focusing on key policy questions. In Ontario, the Securities Transfer Act was enacted in 2006, along with cognate amendments to the Personal Property Security Act aimed at facilitating security interests in all kinds of investment property. The PPSA was twice more amended in 2006, the most important changes being to implement various law reform proposals. New cases include: Saulnier v. Royal Bank of Canada (SCC 2008) (on whether a fishing licence is personal property for PPSA purposes); 1231640 Ontario Inc. (Ont. CA 2007) (on the status of an unperfected security interest in the debtor's receivership); and DaimlerChrysler Services Canada Inc. v. Cameron (BCCA 2007) (on the true lease–finance lease distinction in the context of the PPSA, Part V enforcement provisions).
